Do You Need A Title Search And Insurance On An Reo(bank Owned) Property?and Do You Have To Worry About A C.O.?

Will the bank facilitate out w/ this at all, or do I need to hire my own title insurance company before closing?


Answer: As the seller of the feature, the bank is responsible for providing you with clear title that is certified by a title opinion (not worth much in my view) or a title insurance design. I wouldn't buy a property without title insurance. Good luck to you.
 
 

I Know You Can Get A Title Search Done For A Foreclosing Property But Can You Get Title Insurance?

Is it outrageous to get title insurance to do the fact the current homeowner still technically has a stake until it is auctioned off? If so when do you get title insurance? After the foreclosure?
Do you even need it, if you agree the local records office and there were no existing liens wouldn't that mean that no matter what you legally don't owe a creditor coming out of the woodwork after you were the best-selling high bidder? (very long question, thank you!)


Answer: If it's in foreclosure, there IS A LIEN, the mortgage! You cannot get title insurance on a quality you aren't purchasing. Title insurance is to insure the lender and the buyer that once they CLOSE, they will not be held responsible for liens BEFORE they closed from before owners. It doesn't magically remove liens though, I've done plenty of loans for people that had to use their title insurance to get an old lien off that wasn't theirs, chiefly tax liens.

How Much Does A Title Search Cost On Vacant Property?

I insufficiency to get title search, and title insurance. I heard title search cost depends on the value of the land. Its just vacant land, no buildings. But I don't prerequisite to have it done and it end up costing me $1000. Property is not worth over $5000 market value for sure. I also heard title insurance is very expensive. So if land is valued at $5,000 does anybody know the estimate of what the charge would be for title search & insurance? Thanks so much!!


Answer: The set someone back (premium) of title insurance is based on the sales price. If there isn't a sale but you want to buy title insurance, then use the current market value. There will be an additional (poor) charge for the actual title search. A local title insurance company should be able to give you a quote over the phone. the complete costs should be around a few hundred dollars.

Should I Have A Title Search Done Before I Put Earnest Money Down?

I don't demand to buy the property if it has any leins attached to it.. so if I were to give my earnest $ and they accepted the offer.. I'd have no way of getting that $ back would I? (the earnest $)

We're paying readies for the house, we've already inspected it, the realtor knows that we will be making an offer soon.

Some where in all of this I need to have a title search done and pay for the recording fees. As well as get title insurance.


Answer: normally you would see a mortgage lien on the holdings.

you can visit the county records to view liens against a property. a lot of counties have their websites ONLINE..and you can unquestionably view it there. You will need the owner's full name...and then you can search by deeds.

you CAN get the money back if you put contingencies on the contract.....if you dont then you're out of stroke of luck!

Do Attorneys Issue And Sell Title Insurance Or Simply Buy It On Behalf Of Their Clients?

I take it that attorneys perform title searches and make a title judgment/title assessment. I also know that they would have to hold an insurance commission in the state they are located, be backed by an insurance company(i.e. be an insurance broker/rep), or have an actual insurance company,but all of these are possible to do. What is the natural situation with real estate attorneys and title insurance?


Answer: the attorney has to be approved to do title opinions for title insurance companies. there are required classes and seminars and insurance the attorney must have before they are cleared to do the title check d cash in one's checks and opinion for the title insurance company. Then the title company issues the policy.
