Can I Get Punitive Damages From Insurance Company?

My retain was almost in a head on collision, he swirved and the guy hit the drivers side of the car sort of a side swipe. He ran, my husband chased him down the constabulary arrested him for warrants and hit and run along with child endangerment since he had 2 kids in the car. Can we get punitive damages from the insurance company? My husband is okay and did not go to the doctor but we need to prove a point. We are in NC. Are we going to have to sue this guy or should the insurance company cover
